Welcome to the website of Amelia Conte Photography LLC (“Photographer,” “we,” “our,” or “us”). By accessing this website, submitting an inquiry, or booking photography services, you agree to the following Terms of Service.
1. Website Use
This website is provided for informational, promotional, and booking purposes only. You agree to use this website lawfully and not engage in any activity that interferes with its operation, security, or content.
Unauthorized use of this website may result in legal action.
2. Booking & Client Agreements
Photography services are provided by appointment only. All bookings are subject to acceptance by Amelia Conte Photography LLC.
Upon booking, clients are required to review and sign a Client Agreement / Proposal, which outlines session details, fees, policies, licensing, and legal terms.
In the event of any conflict between these Terms of Service and the signed Client Agreement, the Client Agreement shall govern.
3. Payments & Fees
Session fees, retainers, collections, and products are governed by the Client Agreement provided at booking. All payments are subject to applicable Florida sales tax as required by law.
Payments made toward sessions or services are non-refundable unless expressly stated in writing.
4. Rescheduling & Cancellations
Rescheduling and cancellation policies, including applicable fees and exceptions (such as weather or maternity-related circumstances), are detailed in the Client Agreement and apply once a session is booked.
5. Galleries, Proofing & Image Delivery
Images are delivered through private online galleries or secure digital platforms.
Galleries may be available for a limited time
Clients are responsible for downloading and backing up purchased images
Final images are delivered according to timelines outlined in the Client Agreement
Amelia Conte Photography LLC is not responsible for image loss after gallery expiration or after digital delivery is completed.
6. Artistic Style & Creative Discretion
By booking services, clients acknowledge familiarity with the Photographer’s portfolio and artistic style.
Editing, retouching, posing, lighting, and creative decisions are made at the Photographer’s discretion. Requests for additional edits outside the agreed scope may incur additional fees.
7. Copyright & Image Usage
All photographs and digital files remain the intellectual property of Amelia Conte Photography LLC under United States copyright law.
Clients receive a limited, non-exclusive license for personal or agreed-upon branding use, as detailed in the Client Agreement. Images may not be sold, altered, licensed, or used commercially without prior written consent.
8. Model Release & Privacy Considerations
Unless otherwise agreed in writing, clients grant permission for images to be used for portfolio, marketing, editorial, and promotional purposes.
Sensitive imagery (including implied nude, bare-belly, or nude maternity images) will never be used without the client’s express written consent, in accordance with the Client Agreement.
9. Third-Party Platforms
We utilize third-party platforms for:
Client relationship management (CRM)
Contracts and invoices
Online galleries
Cloud storage
Website hosting and analytics
Use of these services is subject to their respective terms and privacy policies. Amelia Conte Photography LLC is not responsible for outages, data loss, or service interruptions caused by third-party providers.
10. Limitation of Liability
To the fullest extent permitted by law, Amelia Conte Photography LLC shall not be liable for indirect, incidental, or consequential damages arising from use of this website or participation in photography services.
Participation in photography sessions is voluntary and subject to the liability waiver outlined in the Client Agreement.
11. Archival Policy
Clients are solely responsible for archiving and safeguarding their digital images once delivered.
Amelia Conte Photography LLC does not guarantee permanent storage of client images and is not responsible for long-term archival beyond the delivery period outlined in the Client Agreement.
12. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida.
13. Changes to Terms
We reserve the right to update these Terms of Service at any time. Updates will be effective upon posting to this website.
