Client Agreement

This Client Agreement (“Agreement”) governs photography services provided by Amelia Conte Photography LLC (“Photographer,” “we,” “our,” or “us”). By submitting payment, booking a session, or otherwise engaging our services, you acknowledge that you have read, understood, and agree to be bound by the terms outlined below.

1. Acceptance of Agreement

By paying the session fee, booking services, or participating in a photography session with Amelia Conte Photography LLC, you confirm that:

You have read and understood this Client Agreement in its entirety

You agree to all allowing policies, terms, and conditions

You understand that additional details may be provided in a proposal, invoice, or booking confirmation

This Agreement forms a binding contract between you and Amelia Conte Photography LLC.

2. Booking & Payments

All photography services are provided by appointment only. Booking is confirmed upon receipt of payment and acceptance by Photographer.

All payments made toward photography services are non-refundable unless expressly stated otherwise in writing.

Applicable Florida sales tax may apply as required by law.

3. Rescheduling & Cancellations

Rescheduling and cancellation policies, including applicable fees, notice requirements, and exceptions, are provided during the booking process and apply once a session is reserved.

Photographer reserves the right to reschedule due to weather conditions, equipment issues, or circumstances beyond reasonable control.

4. Late Arrivals

Clients arriving late may experience a shortened session or require rescheduling. Photographer is not responsible for lost session time due to client tardiness.

5. Proofing, Galleries & Image Delivery

Clients are provided access to a private online proofing or delivery gallery to view and select images.

Galleries may be available for a limited time

Clients are responsible for downloading and backing up purchased images

Final images are delivered according to timelines provided at booking

Photographer is not responsible for loss of images after digital delivery or gallery expiration.

6. Artistic Style & Creative Discretion

By engaging Photographer, you acknowledge familiarity with the Photographer’s portfolio, aesthetic, and editing style.

All artistic decisions—including editing, retouching, posing, lighting, and composition—are made at the Photographer’s discretion.

7. Prints & Third-Party Vendors

Photographer guarantees print quality only for products ordered directly through Photographer’s professional printing services.

Photographer is not responsible for quality or color variation resulting from third-party printers.

8. Copyright & Image Usage

All photographs and digital images remain the exclusive intellectual property of Amelia Conte Photography LLC under United States copyright law.

Clients receive a limited, non-exclusive license for personal or agreed-upon branding use. Images may not be sold, altered, transferred, or commercially exploited without prior written consent.

9. Model Release & Privacy

Unless otherwise agreed in writing, clients grant Photographer permission to use images for portfolio, marketing, editorial, and promotional purposes.

Sensitive imagery—including implied nude, bare-belly, or nude maternity photographs—will never be used without the client’s express written consent.

10. Third-Party Platforms

Photographer utilizes third-party platforms for client management, contracts, online galleries, cloud storage, and payment processing.

Photographer is not responsible for outages, data loss, or service interruptions caused by third-party providers.

11. Limitation of Liability

Participation in photography sessions is voluntary. To the fullest extent permitted by law, Photographer shall not be liable for injuries, damages, losses, or claims arising during or in connection with photography services.

12. Archival Policy

Clients are solely responsible for archiving and safeguarding their images once delivered.

Photographer does not guarantee permanent storage of client images and is not responsible for long-term archival beyond the delivery period.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

14. Modifications

Photographer reserves the right to modify this Client Agreement at any time. Updates become effective upon posting to this website.
